Agreement

Journey By Light Photography Pty Ltd and the Client hereby acknowledge that the following Standard Terms and Conditions are incorporated in and make a part of the Agreement between the parties hereto.

Engagement and Services

The Agreement is between Journey By Light Photography Pty Ltd and the Client entering into the wedding photography contract. The Client wishes to engage Journey By Light Photography Pty Ltd and Journey By Light Photography Pty Ltd accepts the engagement to hereby:

(a) provide the Services to the Client and

(b) produce Digital Photographs supplied on USB and

(c) provide any other products as per the package (Platinum, Gold, Silver, Bronze, Jack & Jill Deluxe, Jack & Jill or Custom) the client has chosen

Contract and Payment Arrangements

  1. (a) A 50% deposit of selected package is required to secure the clients booking. This fee guarantees the Client the agreed date and time of service which Journey By Light Photography is obliged to provide. (b) This is non refundable or transferable in the event of client cancellation, or an act of government, it being the agreed loss suffered by the photographer. (c) If the client wishes to reschedule their original booking and Journey By Light Photography have availability, then the Client will not lose their deposit. However if Journey By Light Photography are not available for the clients rescheduled date, and a mutually agreed date can not be agreed on, then the client is not entitled to any refund. (d) If Journey By Light Photography have to cancel the Clients reservation for any reason then the deposit and any additional payments made will be refunded in full. (e) Final payment is required no later than one week before your booked date. (f) It is understood by Journey By Light Photography Pty Ltd that by the Client paying their deposit via our electronic invoice and signing our electronic contract made available upon booking, they are accepting our Terms & Conditions set out within.

  2. These Terms and Conditions may be varied at any time, with or without notice to you, at our sole discretion. You accept that these must be read in conjunction with the current Terms and Conditions available at: www.journeybylight.com.au on the bottom of our website. Our terms and conditions apply to all previous, current and future clients.

  3. The Client agrees to pay the Fee to Journey By Light Photography. All additional costs such as permits to photograph in national parks/beaches etc that require permits, if any, are the responsibility of and must be paid for by the Client.

Cancellations and Rescheduling

If the Client cancels 6 months or more before the booked date, then the Client is only entitled to a refund of any fees paid excluding the required 50% deposit fee of chosen package. If the client cancels within 6 months or less from the booked date, then the client is not entitled to any refund of any monies paid. If the Client wishes to reschedule their booked date, then Journey By Light Photography require 3 months notice. If in the case that Journey By Light Photography do not receive notification within this time, availability to honour any requested changes can not be guaranteed and the client risks forfeiting all monies paid. Leniency will be afforded during times of natural disasters and government mandates. To reschedule the Clients original booking date Journey By Light Photography require a further payment equal to 25% of the originally chosen package. This is not an additional payment but makes up part of the total amount due of the final agreed package total.

Schedules

Journey By Light Photography will provide a planner within 8 weeks from the date that the Client has booked for the Client to fill out and complete. The planner will provide information required for Journey By Light Photography to successfully service the Clients booking. It is the responsibility of the Client to inform Journey By Light Photography of any changes or additions made to the planner no sooner than 7 days prior to the booked date. Journey By Light Photography is not responsible for any omissions to the planner that result in not being able to carry out their obligations. Journey By Light Photography will not be held responsible for any lack of photographs delivered due to unknown changes or omissions.

Limitations from venues

Please note that Journey By Light Photography is governed by the restrictions imposed by churches and venues. In some cases, venues restrict the movement of photographers, the use of flash or in extreme cases prevent the taking of photographs at all. It is the responsibility of the Client to inform themselves of these restrictions and in turn inform Journey By Light Photography prior to the booked date. Journey By Light Photography will not be held responsible for any lack of photographs delivered due to these restrictions.

Copyright

Copyright in the photographs is retained only by the Client, for either private, domestic and personal use only. Any sale or commercial use must have written approval by Journey By Light Photography Pty Ltd. Journey By Light Photography Pty Ltd asserts all moral rights attached to the Photographs and the Client does NOT have the right to edit, change, add to, take from, alter or otherwise amend the Photographs without the prior written consent of Journey By Light Photography Pty Ltd except in the case of cropping an image. The Client may submit images to their other vendors for social media use only or to “easy weddings” or “real weddings” sections of websites, magazines, and blogs, however, a credit to Journey By Light Photography as the photographer must be requested and given in the form of either a social media handle or direct website link, however the client shall have no liability if the publication refuses or omits to do so. Image Style & Editing Process

The Client acknowledges that they are familiar with Journey By Light Photography’s style, and that their work is continually evolving and is of a unique and artistic nature, that the photos taken may be different from those taken in the past and that Journey By Light Photography will use their expertise and artistic judgement to create images consistent with their vision of the wedding, which may be different from the Clients. Journey By Light Photography’s editing encompasses colour grading of all selected images for the Client in Lightroom, however, their prices do not include basic editing/retouching carried out in Photoshop such as individual removal of pimples, scars, double chins etc. Additional editing may be requested and a fee per image will be quoted upon request and must be accepted prior to any work being carried out.

Image Use

Journey By Light Photography will use images captured on social media platforms such as Facebook, Instagram and their website, and may use images for samples, contests, exhibition, advertising and self-promotion. Usage outside the bounds of this agreement will require the Client’s consent. This is optional and the Client must inform Journey By Light Photography in writing if they would like to restrict the use/amount of the Clients images or do not wish to have any of their images used in any advertising or promoting. Typically 5-6 images from the wedding day will be shared on Facebook & Instagram as a “sneak-peek” within 48hrs of the wedding day. Following this a picture blog of up to 70 images will be uploaded to Journey By Light Photography’s website, the link again shared via Facebook & Instagram.

Image Storage

Journey By Light Photography will keep copies of the Clients completed jpegs for 5 years and RAW files for two years from the date of their wedding/session. Journey By Light Photography is not liable for any claims after this period. All Client files will be deleted and backups will be purged after this period.

Delivery

Clients are provided with two opportunities to make changes to their in-house designed photo albums before being charged a small design fee for additional changes. A low resolution PDF proof will be sent via email for the client to review initially on completion of first design and on each occasion thereafter changes are made.

All Clients will be supplied with high-resolution jpeg files upon final delivery on USB. Images deliverable in High-Resolution (or known as High-Res) are 300DPI with at least 2000 Pixels in the longest edge. At no stage will RAW/unedited files be delivered.

Online albums of the Client’s complete set, fully curated and edited, may take up to 4 months (excluding public holidays) from their booked date to be uploaded to Journey By Light Photography’s website for viewing, depending on how busy the wedding season has been. Journey By Light Photography cannot guarantee a completion date due to the nature of their work. Factors such as power outages, technical issues, and sickness may delay the delivery of the Clients photos. Journey By Light Photography will always endeavour to complete the Client’s photos in a timely manner but if Journey By Light Photography are not able to deliver within 4 months they will inform the Client of their progress and provide an approximate completion date.

Clients will be asked to submit their image selections as per their chosen package for albums, framed prints and photo mount stands from their respective online albums. Clients will be also asked to provide text and cover selections for albums. Clients will also be asked to select their favoured colour from our framing options. Final delivery of USB’s, albums and/or framed prints may take up to 8 weeks (excluding public holidays and delivery times) from the time Journey By Light Photography receive selections as per the Clients package. Upon completion of the Clients package Journey By Light Photography will offer to post via Australia Post with insurance and tracking, or provide a pick up address in Malmsbury.

Should the Client not inform Journey By Light Photography of their selections within 4 months, they agree to incur any additional costs which may arise due to supplier price increases, which must be paid for by the Client in full before the agreed package is delivered.

Postage costs of the Client’s chosen package are factored in to the final cost for Victorian addresses only. Interstate deliveries may attract an additional charge. Packages are carefully packed for safe delivery and are sent to the client via Australia Post with tracking and insurance for the cost price to replace should the goods arrive damaged. In the event that this happens it is up to the Client to make a claim with Australia Post immediately. Journey By Light Photography will assist the Client during this process.

Attendance

In the unlikely event Journey By Light Photography are unable to complete the agreed services due to fire, casualty, or photographer illness, then Journey By Light Photography shall refund any funds previously paid to the Client but shall have no further liability with respect to the Agreement; In the case of illness Journey By Light Photography will work together with the Client to find a professional photographer to cover their booking.

Loss or Damage

Journey By Light Photography Pty Ltd shall carry out the agreed service with due and professional diligence. Elements that are beyond their control include interruption due to guest photographers, faulty material, equipment failure or damage or loss of digital files. In the case of digital file loss, Journey By Light Photography and the Client agree that the liability of Journey By Light Photography shall be limited to a full or partial refund of any money paid under this agreement, which shall be in full & final satisfaction of any damage or loss suffered.

Communication

It is understood that it is the Clients responsibility to inform Journey By Light Photography by email for all communications including but not limited to any date or location changes. Journey By Light Photography is not liable for any claims for messages sent by mobile text messages or social network websites.

Coverage

Every effort will be made to capture as many moments of the Clients wedding day as humanly possible however it is not possible to capture absolutely everything. This is particularly the case if the Client has chosen one photographer rather than two. If the Client have suggestions or desires for photos to be captured such as the brides fathers first look or a set photo of the groom and his mum, Journey By Light Photography request the Client to communicate suggestions via email and they will do their best to capture them. Because of the ever-changing nature of wedding days, not everything can be covered. Journey By Light Photography is not responsible for a missing family member(s) during the family photo session.

Guest Cooperation

  1. It is understood that no other professional photographer shall be allowed to photograph at the venue (wedding, portrait, family photography , etc.) while Journey By Light Photography is working, and that any breach of this agreement will constitute a reason for non-completion of the job with no liability to Journey By Light Photography and loss of any fees paid by the Client.

  2. The Client is responsible for the conduct of their guests. Journey By Light Photography will not tolerate verbally or physically abusive behaviour. If the Client is unable to control the conduct of their guests, resulting in an unacceptable degree of misconduct, or if the conduct of any of their guests damages the equipment of the photographer/s, this will result in the early or immediate departure of the photographer/s. The Client understands that in such an event, no refunds will be granted.

  3. In the event that the family/guests are taking photos, Journey By Light Photography is not responsible for obstructed photos or photos ruined due to separate flashes going off or due to any other behaviour from guests. Journey By Light Photography is not responsible for obstructed or ruine
    d photos due to activities by other vendors and venue staff.

Breaks & Meals

Journey By Light Photography will be allowed one 20 minute break at their own discretion, and bathroom breaks when necessary. Additionally, each photographer will be provided a full guest meal for any photography package that’s duration includes coverage of reception for a period of no more than 30 mins. If no meal is provided, the photographer(s) reserves the right to go off-site for a meal for 45 minutes.

Minors

It is the Client’s responsibility to take care of any children; Journey By Light Photography will not accept any responsibility due to any accident to children or damage to public or private properties during the photo session or consultation.
